Terms of Service – Kaleidoscope

These Terms of Service (“Terms”) govern your use of the website

kaleidoscope.inc (the “Site”), operated by Kaleidoscope 8, Inc.

(“Kaleidoscope,” “we,” “us,” or “our”). By using the Site, you agree

to these Terms. If you don’t agree, please don’t use the Site.

Use of the Site

You may use the Site to learn about the Colormaster product, access

support resources, and contact us. You agree not to misuse the Site —

for example, by attempting to disrupt its operation, scrape it at

scale without permission, or use it for any unlawful purpose.

Purchases

Colormaster units and dye bottle refills are sold through our Shopify

storefront, which is a separate service from this Site. All purchases,

payments, shipping, and returns are governed by the terms presented

to you at checkout on that storefront, not by these Terms. Please

review those terms before purchasing.

The Colormaster App

Use of the Colormaster mobile app (available on the App Store and

Google Play) is governed by the terms presented within the app,

which may differ from these Terms.

Product Use

Colormaster is designed to dispense food-safe dye for use in food

preparation, following the instructions provided with the product and

in our setup guides. You are responsible for using only supported

dyes, following food-safety practices appropriate to your kitchen,

and using the product as intended. Kaleidoscope is not responsible

for outcomes resulting from misuse, unsupported third-party dye, or

failure to follow provided instructions.

Intellectual Property

The Site’s content — including text, graphics, logos, and design —

is owned by Kaleidoscope or its licensors and is protected by

applicable intellectual property laws. You may not reproduce,

distribute, or create derivative works from the Site’s content

without our permission.

Third-Party Services

The Site uses third-party tools (including Tidio for chat and UserWay

for accessibility) to provide certain features. Your use of those

features is also subject to those providers’ own terms.

Disclaimers

The Site and its content are provided “as is,” without warranties of

any kind, to the fullest extent permitted by law. We don’t guarantee

the Site will be uninterrupted, error-free, or fully available at all

times.

Limitation of Liability

To the fullest extent permitted by law, Kaleidoscope will not be

liable for any indirect, incidental, or consequential damages arising

from your use of the Site. This does not limit any liability that

cannot be limited under applicable law.

Governing Law

These Terms are governed by the laws of the State of Texas, without

regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. We’ll update the “Last

updated” date above when we do. Continued use of the Site after

changes means you accept the updated Terms.
